CCRs dwT #32: Weed Bust

dwT #32:   Busted?  While not wanting to call Code Enforcement and be a snitch, the CCR wonders if the city might be in violation of Ord. No. 8067, &1, 10-10-02, Sec. 33-21, b: Weeds...at the: Irving ConstructionRunAmokProject Sink Hole, otherwise known as the new library building site.


Backstory clue for the information impaired:   As previously noted in ZAP! #138 (see link below), construction on the new library is at a standstill due to the continuous seeping of water into the proposed basement.  And during this building hiatus, the weeds and sunflowers have taken good root.  It almost appears as if the city is going into the organic gardening business due to all the wild growth.  While we favor organic resources, this is a sightly appearance across from city hall -- a living and growing mud hole that could even potentially become the city’s first sink hole.  And let’s not forget the additional consideration of summer’s arch enemy...West Nile-carrying mosquitoes looking for a home!  For those requiring factual documentation other than the above noted ordinance, here is the weed (non-smokeable type) detail:  “A person owning, claiming, occupying, or having supervision or control of any real property, occupied or unoccupied, within the city limits…commits an offense if said person permits or allows any stagnant or unwholesome water, sinks, filth, carrion, weeds, rubbish, brush, refuse, junk or garbage...to accumulate or remain on such real property…Such condition or conditions are hereby defined as public nuisances.”  The ordinance also reflects that to be considered weeds, the offenders must be a height greater than ten (10) inches...which begs the question: Would the sunflower stalks be considered weeds too?


Update Note:  It was observed that on 8-31-13 the weeds in and around the "green" sink hole had been cut down by the city.  It's good to know that someone actually reads these reports!  The next major hurdle for the city on this project: How much additionally will it cost tax payers for the city to fix this bumbling bureaucratic sink hole?
